Shardimage Terms Of Service
Welcome to Shardimage, these terms of service ("Terms") cover your use and access to our cloud-based image management service (the "Service") by Zero Playground Pte. Ltd.
The following terms and conditions apply to all visitors or users of the Website. Please read the Terms carefully before using the Website. By accessing or using the Service, you acknowledge the acceptance of these Terms and to review our Privacy Policy.
The Service
Shardimage offers image hosting services. You can store images that you may display on your websites.
By modifying the images' URL, you may perform various image editing functions: resizing, cropping, watermarking, etc.
Shardimage offers you these functions in real time, dynamically, by modifying the URL.
You will be able to use the system by logging in the website or through using an API.
There are plugins for most of the biggest frameworks, site engines and mobile operating systems; it can be easily integrated into their workflow.
Your rights
You are able to use the Service and you may not use the Service for any other purposes not provided explicitly in these Terms. You have the non-exclusive, non-assignable, royalty free, worldwide limited right to access and use the Service. You may allow other user on your behalf to use the Service in accordance with this Terms and your order. You are responsible for your users’ compliance.
Shardimage grants you full-scope usage of the Service.
Your Account
If you register for an account, we will ask you to provide certain personal information. It is obligatory to provide your username, email address and password for registration and notice purposes. Shardimage grants you full confidentiality in connection with your personal information.
Always use the logout link when you are finished with your account and close the browser window. Please change your password at least once every six months.
In case of Shardimage experiences any misuse or unauthorized use of your account, Shardimage will immediately alert you.
When registering for an account, we will need your payment details to process your payment for the service. You can choose to use PayPal or credit card to complete payment transactions.
On your account page, you are able to terminate your account, or by contacting Shardimage via email. After the termination of your account, you may no longer be able to access your content. By deleting your account, your personal information and your content, like your pictures, cloud, filters) will be deleted and you may no longer be able to access them.
Acceptable Use of the Service
Please use the Service for legal purposes, you will abide by applicable laws, rules and regulations and by the Terms. You may not use the Service for any purposes not allowed by the applicable laws, rules and regulations and by these Terms. Otherwise Shardimage may temporarily or permanently deny your access, limit your usage or terminate your user account.
In case of any incorrect use of the Service, Shardimage will prohibit you from accessing the Service, may remove your content and take further technical and legal measures.
You will responsible for all acts associated with your account, accessing, using of the Service by you or third party on your behalf or under your permission.
Privacy
Shardimage is firmly committed to maintaining your privacy. Shardimage puts great efforts to uphold the highest privacy standards on the website and grants the full discretion of your personal information.

Content
When you use the Service, you are able to provide your files and your content. You need to comply with the Acceptable Use. You as the user of the Service will be responsible for the content of your account. You represent and warrant that you will prohibit the usage of Service for any illegal or abusive content or activity.
Please consider every time you upload your content that is comply with requirements of the applicable laws, rules, regulations and the Terms.
Shardimage will not be responsible for the content. Shardimage may review your conduct and content for compliance with these Terms and the Acceptable Use if it is in contrary to the above stated, Shardimage may remove and block access to such content.
If Shardimage notice that your Content violates other person’s rights, Shardimage immediately contacts you for the certification of your usage, in case you are not able to certify it, then removes such content
Please contact Shardimage, if you believe your rights are violated by any possible form and Shardimage will take the necessary measures to process your complaint. Shardimage will review the complaint and may remove the content.
Service Fees
Shardimage offers you the Service for a fee defined on the website. After creating and completing your account, Shardimage provides you a possibility to use the services within the provided limit (trial period). Once the limit is reached the services are provided if the fee is paid. The payment is performed to upload a certain sum to the user’s account. The fee of the different services (e.g. storage space, sharing, modification, etc.) are listed on the website. Once the service is performed, Shardimage deducts the fee from the user’s account. Shardimage may deduct the fee from the account anytime after the service is provided. Once the account is used, the services are not provided. The user may upload the account automatically.
You will be responsible for the payment of your account. The payment will include applicable taxes. Fees will be regarded as paid only after your payment has been confirmed.
You can choose to use PayPal or credit card to complete payment transactions.
In case you may not fee the requested fee on time, Shardimage reserves the right to suspend our Service or reduce it.
You may cancel your Account at any time, but you won’t be issued a refund unless it’s legally required.
Shardimage may change the fee of the services, Shardimage will notify you in reasonable time on its website and via email.
Intellectual Property
The Service is protected by copyright and trademark. These Terms do not grant you any right, title or interest in the Services, others’ content in the Service.
Except your Account’s content any intellectual property and goodwill associated with the Service are owned by Shardimage.
You will be responsible for your content. Content in the Services may be protected by other’s intellectual property rights.
You grant Shardimage the permission to use your Content, for the purposes of providing, developing and supporting the Service.
In case you experience copyright infringement, we examine the alleged infringement and respond to it, if they do not comply with the law. We reserve the right to delete or disable content alleged to be infringing and terminate accounts.
Termination
You are free to stop using our Services at any time. We also reserve the right to suspend or end the Service at any time at our discretion and without notice, in case you are not complying with these Terms.

Shardimage puts great efforts to uphold the highest standards of confidentiality of your confidential information.
The below stated will not considered as confidential information: i) information already known to Shardimage without an obligation of confidentiality, ii) information that is or becomes publicly known other than through a breach by us, or iii) information that is independently developed by Shardimage.
Shardimage will not use, disclose or have your confidential information disclosed, directly or indirectly to any third party, except as specifically required to provide you the Service, or subject to your prior permission.
Warranty
Shardimage makes no warranties, either expressed or implied, about the Service. The Service is provided “As Is”. Shardimage also disclaim any warranties of merchantability, fitness for a particular purpose, non-infringement, compatibility or security.
Limitation of Liability
To the fullest extent permitted by law, expect for any liability for Shardimage’s fraud, fraudulent misrepresentation, or gross negligence in no event will Shardimage, suppliers or distributors be liable to the below stated to you or to any other person.
Shardimage will not be liable for any indirect, special, incidental, punitive, exemplary or consequential damages, or any loss of data use, data, business, revenue, or profits, also in connection with the inability to use the service, or from any failure, breakdown in the Service.
Resolving Disputes, Governing Law and Jurisdiction

Any dispute related to these Terms or the Service will be governed by solely by the laws of Singapore.
